Contracts formed on foot of a purchase made through this website will be formed with [Irish LCD Consulting Limited] (“Irish LCD” or “We” in these Terms and Conditions) a company incorporated in the Republic of Ireland Company Number 455896/VAT Number 9695787F and having its registered office at Unit 28 East Link Business Park, Ballysimon Road, Limerick.
In order to place your order, you will be required to indicate your acceptance of these Terms and Conditions by clicking “I AGREE” at the foot of this section.
Please read these Terms and Conditions carefully. They do not affect your statutory rights.
Any reference in these Terms and Conditions to “Business Days” shall be a reference to a day when banks in the Republic of Ireland are open for business.
Terms and Conditions
1.1 These Terms and Conditions apply to all transactions on this website and all contracts formed between you and Irish LCD. Irish LCD reserves the right to change these Terms and Conditions at any time. Any changes will take effect from the date they are posted on this website (see date above). You will be required to agree to the current Terms and Conditions each time you place an order on this website and your acceptance of same shall indicate acceptance of the Irish LCD’s Terms and Conditions as at the date of such acceptance.
1.2 Our Terms and Conditions are designed to ensure that all our customers can shop with confidence. To order goods through this web site you must be 18 years of age or over.
1.3 These Terms and Conditions set out the whole of the agreement relating to the supply of goods between Irish LCD and you. These Terms and Conditions will supersede any prior agreements or understandings you may have had with Irish LCD and no variation of these Terms and Conditions shall be incorporated into this agreement unless agreed to in writing by Irish LCD.
Contract
2.1 We shall sell to you and you shall purchase only those goods set out in an order placed by you and subsequently accepted by Irish LCD . We will treat each order or pre-order for goods as an offer by you to purchase the goods subject to these Terms and Conditions and we reserve the right to reject any order or pre-order and no binding contract shall come into existence until Irish LCD has received payment for the goods the subject of the order and you have received an “Order Accepted Email”, as described below, provided always that goods displayed as “out of stock” when an order is placed will be subject to the terms of Clause 2.3 below. Each product order accepted by Irish LCD shall constitute a separate and independent contract between you and Irish LCD.
2.2 On receipt of payment from you for the goods the subject of your order, you will receive email confirmation that your order is awaiting dispatch together with your order number and details of the products you have ordered (an “Order Accepted Email”). Payment for the goods the subject of your order will be processed at the time an Order Accepted Email is sent to you.
2.3 Out of Stock Products
Where goods are not currently in stock this will be indicated on the product display page. Out of stock goods may be pre-ordered and on receipt of payment for the goods the subject of a pre-order, you will receive email confirmation that your order is awaiting re-stocking together with your order number and details of the products you have pre-ordered (a “Pre-Order Accepted Email”). Where the goods the subject of your pre-order have been re-stocked and are awaiting dispatch, you will receive a further email to notify you of the change in status of your order.
2.3.1 Due to matters beyond Irish LCD’s control including but not limited to product availability and changes in specification made by the manufacturer, we cannot guarantee that re-stocked goods will exactly match the goods the subject of your pre-order. Where the re-stocked product does not meet the exact specifications of your pre-ordered product you may cancel your pre-order at no cost or penalty and Irish LCD will offer you a full refund. Any right of cancellation pursuant to this Clause 2.3.1 must be exercised within seven Businessworking Ddays of our email notification to you of your right to cancel the pre-order.
2.3.2 Where the goods the subject of your pre-order have not been restocked within thirty days of your receipt of a Pre-Order Accepted Email you may cancel your pre-order at no cost or penalty and Irish LCD will offer you a full refund provided always that any right of cancellation under this Clause 2.3.2 will not be exercisable where you have received notification that your goods have been restocked and are awaiting dispatch.
The right of cancellation contained in Clauses 2.3.1 and 2.3.2 above is in addition to and without prejudice to your rights under Clause 5 below.
2.4 Property and Risk
2.4.1 Risk in the product(s) the subject of your order shall pass to you at the time of delivery. Delivery shall be deemed to occur at the time when the product(s) arrive at the delivery address provided by you in your order. From the time of receipted delivery of the product(s), any loss or damage to the product(s) shall be at your own risk.
2.4.2 We will retain title and ownership of the product(s) the subject of your order until we have received payment in full of cleared funds for all sums due and/or owing for all products supplied to you by Irish LCD under this or any other contract which you have entered into with Irish LCD. You will not be entitled to re-sell any product(s) in which title and ownership still vests with Irish LCD.
2.5 Product Information
Product specifications, images and other material relating to the goods displayed on our website are based on information made available by manufacturers and suppliers. Our intention is to ensure that all product information and specifications are accurate and up to date, however Irish LCD makes no representations or warranties of any kind about the accuracy and completeness of the information and specifications displayed or the suitability for any particular purpose of the goods displayed on this website. Full specifications and information relating to products may be found on the manufacturers’ websites.
2.6 Pricing Errors
All reasonable efforts have been made by Irish LCD to ensure that the information on pricing contained on this website is accurate however, without prejudice to the right of Irish LCD to reject an order under Clause 2.1 above, Irish LCD reserves the right to reject any order based on an inaccuracy or manifest error in the price or description of a product as same appears on this website. In the event that you have placed an order based on such an error or inaccuracy, Irish LCD will contact you to indicate the nature of such error or inaccuracy.
Prices
3.1 The prices displayed on the website are in Euros and include all taxes.The cost of delivery is indicated to you as products are chosen and is identified in the details of the total price provided to you prior to you placing your order. We reserve the right to modify our prices at any time but any such price changes will not apply retrospectively and the rates displayed on this website at the time your order was placed will apply to your order subject only to Clause 2.5 above.
3.2 Price Match Guarantee Conditions
3.2.1 Price Match Guarantee comparison prices exclude any sale, promotional, discount, opening or closing down offers, ex-display prices, foreign import prices, clearance price, special orders, extended warranty prices, prices available only to members of a restricted membership website, product prices drawn from any bidding or auction system and prices contained in advertisements placed by an individual in their personal capacity.
3.2.2 A comparison price for Price Match Guarantee will be a valid comparison price where it is a price displayed on another Irish website within 48 hours of you placing your order with Irish LCD provided that the comparison price is not otherwise excluded by the terms of Clause 3.2.1 above.
3.2.3 Price Match Guarantee only applies to products in the following ranges: CAMERA, CAMCORDER, TV VIDEO, I.T. PRODUCTS and SOUND (accessories and consumables not included).
3.2.4 The product price is the price displayed on this website at the time you place your order (inclusive of taxes) excluding discounts such as promotional offers or gift certificates.
3.2.5 Price Match Guarantee is limited to one refund per household for each product purchased on www.irishlcd.ie.
3.2.6 Proof of the comparison price must be provided in order to avail of Price Match Guarantee and the comparison price must be verified by Irish LCD. The decision of Irish LCD as to the eligibility of the comparison price for Price Match Guarantee shall be final.
3.3 The person registered with Irish LCD will remain responsible for all activities, transactions and payments incurred on their account at all times. If the password on your Irish LCD account has been compromised or disclosed to an unauthorised user it is your responsibility to contact Irish LCD immediately.
Delivery
4.1 Delivery will be made as soon as possible following your receipt of an Order Accepted Email. An estimated time for delivery will be provided based on availability, time for processing the dispatch and delivery transit time. All estimates of time are provided on the basis of Business Days and exclusive of public holidays and weekends..
4.2 All deliveries must be signed for by the Irish LCD account holder who placed the order unless otherwise indicated by Irish LCD in writing. Please retain the receipt enclosed with your goods on delivery.
4.3 Irish LCD will engage a third party courier to deliver your goods or in certain circumstances may send the goods to you by post. All total prices are inclusive of a standard delivery charge calculated on weight and distance. Delivery charges are provided for delivery within the Republic of Ireland however, remote rural areas of Ireland may incur additional charges and also longer estimated times for delivery. Where a national carrier or courier’s attempts at delivery are unsuccessful they may require collection of the goods from their premises within a certain timeframe. If goods are returned to Irish LCD following the expiry of this timeframe and require re-delivery, a further delivery charge may be incurred by you.
4.4 Different product orders placed at the same time in the same order may arrive separately and each product order will be treated as a separate sale and a separate contract between you and Irish LCD. Failure by Irish LCD to deliver any one or more of the products the subject of your order will not entitle you to repudiate any contract in respect of other products for which you have placed an order with Irish LCD.
4.5 Irish LCD shall have no liability whatsoever to you for any delay or failure to deliver goods which is attributable to circumstances beyond its reasonable control including matters such as industrial disputes, extreme weather conditions, war or disturbances of that nature. If we fail for any reason within our control to deliver to you goods the subject of your order any reimbursement shall be no more thanlimited to the price paid by you for the goods in question.
4.6 If goods arrive in a damaged condition you must sign the delivery note as damaged, and write a brief description of the damage on the note.'Unchecked' will not be accepted as a valid status.In such circumstances, you must inform Irish LCD of the damaged condition of the goods as delivered in detail within 48 hours from of the delivery date, quoting your order number via a Returns Merchandise Authorisation as outlined in Clause 5.1. Items returned as damaged in transit must be returned complete with all accessories and documentation and to the extent possible, with their original packaging. Damaged goods signed for in good condition may not be accepted for return.
4.7 It is your responsibility to notify Irish LCD via a Returns Merchandise Authorisation of any incorrect goods delivered within 48 hours from date of delivery, quoting your order number. It is also your responsibility to sign for the correct number of packages as shown on the carrier’s delivery note, any shortages must be noted on the delivery note and you must notify us of this fact via a Returns Merchandise Authorisation within 48 hours from the delivery date, quoting the order number.
Returns and Faults
5.1 Returns Merchandise Authorisation (in these Terms and Conditions an “RMA”)
An online RMA must be completed in respect of all returns, faults or reporting of damage to goods in transit. One online RMA must be completed per each item returned. No returned products will be accepted without a completed RMA.
5,2 European Communities (Protection of Consumers in Respect of Contracts made by means of Distance Communication) Regulations (in these Terms and Conditions the “Distance Selling Regulations”)
5.2.1 Subject to the exceptions outlined in this Clause 5.2, pursuant to the Distance Selling Regulations you have a right to cancel the contract you have made with Irish LCD within 7 working days starting from the day after the delivery to you without giving a reason therefore. Please inform Irish LCD of your request to cancel your order by completing an online RMA within seven working days from the date of delivery before returning the goods to us.
5.2.2 You will incur no penalty for a return of goods pursuant to this Clause 5.2 however, you will incur the direct cost of returning the goods on your own account and at your own risk.
5.2.3 Goods returned pursuant to this Clause 5.2 should be in the condition that you recieved them in and accordingly, the goods must be complete, unused and undamaged. If you have unpackaged the goods to examine the product you must do so without damaging or marking the product in any way. Packaging of the goods should, as far as is practicable, remain in good condition provided always that any returned audio or video recordings must remain sealed.
5.2.4 Your right to return goods pursuant to this Clause 5.2 is subject to the following exceptions: -
a) You will not be entitled to cancel a contract with Irish LCD in respect of any goods which have been made to your specifications or have otherwise been personalised for you.
b) You will not be entitled to cancel a contract with Irish LCD in respect of any audio or visual recordings where the packaging has been unsealed.
c) The right to cancel a contract with Irish LCD pursuant to the Distance Selling Regulations and this Clause 5.2 is available only to an individual acting outside that person’s trade, business or profession and will not be available to business customers.
5.2.5 Where you exercise your right of return pursuant to the Distance Selling Regulations you will be reimbursed as soon as possible but in any event within 30 days of your exercise of the right.
5.2.6 On the expiry of the seven day period from the date of delivery you will have no automatic entitlement to a refund and refunds or exchanges following the expiry of this time period (if any) will be entirely at the discretion of Irish LCD.
5.3 Faulty Goods
5.3.1 Within 28 Days
5.3.1.1 A product is deemed faulty on arrival if it shows symptoms of hardware failure preventing its basic operation. If you consider the product faulty, you must register this within 28 days (or 7 days in the case offor Sony, Panasonic or Pioneer products) of the delivery date by completing an online RMA. Please provide as much detail as possible in the Reason for Return / Description of Fault box. [Note: descriptions like "Broken", "Dead", "No Function" will not be sufficient. By filling out as much information as possible, you will assist in an prompt diagnosis of your product's fault.]
5.3.1.2 Any product returned as faulty within this 28 day time period must be assessed by the manufacturer to confirm that fault. This process can take up to 72 hours from collection of the product. Should a fault be confirmed then Irish LCD will offer a full refund or replacement of the product.
5.3.1.3 Any efforts by you to correct or repair a fault in the product supplied to you may disentitle you to a refund or replacement.
5.3.1.4 Customers must retain packaging where possible. Customers without original packaging may be required to return their goods to the manufacturer directly for repair under the terms of the product warranty.
5.3.1.5 If the product does not contain any fault it will be returned to you and no refund will apply. You may incur costs of re-delivery in the event that there is no fault on a product returned by you as faulty.
5.3.1.6 Dead Pixel Policy
LCD displays are made up of a set number of pixels and each pixel is made from 3 sub pixels; one red, one blue and one green. Due to the nature of the manufacturing process, occasional defects can occur. Pixel defects or failures cannot be fixed or repaired and can happen at any stage in the product’s life. To regulate the acceptability of defects and to protect the end user,the International Organisation for Standardisation (ISO) have created a standard for manufacturers to follow. ISO 13406-2 recommends how many defaults are acceptable in a display before replacement is required and the majority of manufacturers conform to and support the ISO 13406-2 standard.Please check the accepted tolerances on manufacturer sites before returning products due to dead pixels as accepted tolerances within the ISO standard will not be regarded as rendering the product faulty.
5.3.2 After the expiration of 28 Days
If a product purchased by you develops a fault after the expiration of 28 days from the date of delivery or if you fail to notify Irish LCD of a fault within this 28 day period, then provided your item is within its product warranty period, you may be entitled to a repair under the manufacturer’s product warranty. Following the expiration of 28 days from the date of delivery of the product we request that any faulty faults in a product items will be dealt with between you andraised directly with the manufacturer of the product.
Product Installation
6.1 Where you have requested Irish LCD to install your product, an installation charge will apply. The installation charge will be identified in the details of the total price provided to you prior to you placing your order.
6.2 The contract between you and Irish LCD will include the provision of installation services only where such services are requested by you and where Irish LCD agrees to provide such services in an Order Accepted Email.
6.3 Irish LCD reserves the right to engage third parties to carry out installation services on its behalf and through acceptance of these Terms and Conditions you hereby consent to such third party providing the installation services on Irish LCD’s behalf.
Waste Management (Waste Electrical and Electronic Equipment) Regulations 2005 – 2008 (the “WEEE Regulations”)
7.1 Irish LCD is registered with WEEE Register Society Limited as a producer of electrical and electronic equipment within the meaning of the WEEE Regulations (Registration Number 01299W)
7.2 Where you purchase electrical and electronic equipment from Irish LCD, we will take back waste electrical and electronic equipment from you free of charge on a one for one basis provided i) you are a private household; and ii) the waste electrical and electronic equipment is of equivalent type or has fulfilled the same function as that purchased by you from Irish LCD
7.3 Where you have indicated to Irish LCD that you wish to have waste electrical and electronic equipment collected on a one for one basis as outlined in Clause 7.2 above, Irish LCD will endeavour to provide you with at least 24 hours notice of the anticipated time of delivery of the goods the subject of your order to facilitate a simultaneous collection of your waste electrical and electronic equipment.
7.4 Where your waste electrical and electronic equipment is not available for immediate return by reason of Irish LCD being unable to provide you with 24 hours notice of the anticipated time of collection for your waste electrical and electronic equipment, we will arrange for collection of same within 15 days of the date of delivery of the goods the subject of your order and will endeavour to provide you with 24 hours notice of the time of such collection.
7.5 Where your waste electrical and electronic equipment is not available for immediate return to us for any reason whatsoever, we will accept same at our premises at Unit 28 East Link Business Park, Ballysimon Road, Limerick up to a maximum of 30 days from the date of delivery of the goods the subject of your order.
Methods of Payment and Security
8.1 Methods of Payment
Irish LCD accepts cash, credit card or debit card payments via Payzone and Realex only. Cheques or bBank drafts drawn on an Irish bank and An Post postal money orders will also be accepted as methods of payment. Personal cheques and other methods will not be accepted by Irish LCD as payment.
8.1.1 Bank drafts or postal money orders
If paying via this method, please make the draft or money order payable to Irishlcd Consulting Limited.
8.1.2 Payzone
Customers who do not wish to pay for their order online may process their payment by cash or credit card at any Payzone outlet. For a list of Payzone outlets in your area please follow this link to the Payzone website.
8.1.3 Realex
Credit card payments made online to Irish LCD will be processed by Pay and Shop Limited, a company incorporated in the Republic of Ireland under company number 324929 trading as Realex Payments (hereinafter referred to as “Realex”). The payment will be processed on a payments page hosted by Realex on a secure server. When paying via this method you will be redirected from the Irish LCD website to the Realex payments page prior to inputting your credit card details and consequently, Irish LCD will not obtain or hold your credit cards details at any point during your contractual relationship with us. 8.2 Irish LCD’s server has been certified by an international certifying authority, [VeriSign, Inc.]. All information submitted by you to Irish LCD via the internet is encrypted via Secure Sockets Layer (SSL) technology.

These website links are provided for convenience only and Irish LCD accepts no responsibility or liability for the content or information contained on any such linked websites and the presence of any such link shall in no way be interpreted as an endorsement or approval by Irish LCD of that website or, its content or the entity maintaining the website .
9.2 Intellectual Property
Irish LCD owns all intellectual property rights in all material, design and content on this website (save where otherwise indicated). You are permitted to download and copy the content of this website solely for your personal use and solely in connection with purchasing products from Irish LCD. Any further use of the content of this website is unauthorised by Irish LCD and may constitute infringement of Irish LCD’s intellectual property rights.
9.3 Severability
If any portion of these Terms and Conditions is deemed to be or becomes invalid, illegal, void or unenforceable under applicable laws , such provision will be deemed amended to conform to applicable laws so as to be valid and enforceable, or if it cannot be so amended without materially altering the intention of the parties, it will be deleted, but the validity, legality and enforceability of the remaining provisions of these Terms and Conditions shall not be impaired in any way an d shall remain in full force and effect.
9.4 Liability
Without prejudice to any specific exclusion of liability in these Terms and Conditions, Irish LCD will have no liability on foot of an order or purchase placed by you for any indirect, consequential, special, incidental or punitive loss or damage (whether for loss of current or future profits, loss of enterprise value, business interruption, loss of opportunity or otherwise).
9.5 Non-Excludable Liability
Nothing in these Terms and Conditions shall exclude or limit the liability of Irish LCD for death or personal injury resulting from the negligence of Irish LCD or its employees, nor shall they operate to exclude or limit any statutory rights which cannot be legally excluded or limited including the statutory rights of a consumer.
9.6 Governing Law
These Terms and Conditions and the contract formed between Irish LCD and you is governed by and interpreted in accordance with Irish law.
Data Protection Policy
Irish LCD is committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Acts 1998-2003, as same may be amended from time to time).
The type of information we will collect about you includes your:
• name
• address
• telephone numbers
• email address
• IP addresses
• history of purchases
• marketing preferences
Irish LCD will not obtain or hold your credit card details at any point during your contractual relationship with us. Credit card payments made online to Irish LCD are processed via Pay and Shop Limited trading as Realex Payments (registered with the Office of the Data Protection Commissioner under Reference Number 4539/A). The information we hold will be based on information provided by you to Irish LCD and we will keep this information accurate and complete. Insofar as it is possible to do so we shall endeavour to keep this information up to date. You can check what information we hold about you if you email us.
We will process the information in the following manner: -
• to process your order;
• to arrange delivery of your products and for this purpose your contact details may be disclosed to a third party courier;
• to provide you with the best possible service;
• where requested by you to do so, to arrange installation of your products and for this purpose your contact details may be disclosed to a third party carrying out the installation services;
• once your transaction has been completed, we will only e-mail you in the future where you have provided your consent to do so.
